1.         What is “probable cause” for a police to conduct a search? What is “reasonable suspicion” for a stop and frisk? Please give your definitions and examples for each term.

 

 

 

2.         Search with warrants protects the suspect’s rights from the Fourth Amendment. Some people regard warrantless searches problematic. Police officers may intimidate suspects to cooperate (i.e. consent with the search) in order to prevent a more difficult situation he/she will encounter. Do you think that warrantless search is necessary? In two paragraphs, please write down your opinion on warrantless searches. Please provide at least two advantages and disadvantages of them.

4.         In assignment 5 , we asked you to write down one comment and one question after reading Meares (2015). This week, please pick one question from other students, and post your answer to the question.

 

              While reading Meares (2015) I really was interested in the on pg 172 where the violations on certain amendments and how they would be used in a certain situation. To use these amendments I never knew you needed a certain amount of information to make it eligible. I'm wondering if the police really do have enough information to make calls from the fourth admendment to justify a stop or a frisk? By this I mean if the police just do these kinds of things out of their own liking or out of actual reasoning.
